2.1 As required by Commission Regulation (EU) No 1332/2011, ICAO SUPPS DOC 7030 for the EUR Region and AIC 10/03,
ACAS II shall be carried and operated by all turbine-engined aeroplanes having a maximum certificated take-off mass exceeding 5700 kg or authorized to carry more than 19 passengers.
2.2 ACAS II shall be carried and operated by aircraft in the Santa Maria FIR according to the standards and procedures published on ICAO Annex 2 (Chapter 3), Annex 6-Part I (Chapter 6), Annex 6-Part II (Chapter 3), PANS OPS-Part III (Volume I) and
PANS ATM (Chapter 4 and 10), as stated on ICAO SUPPS DOC 7030 for the NAT Region.
1. Commercial air transport aircraft operating in Portugal must adhere to the provisions of Annex 6 - Operation of Aircraft, Part I, Chapter 6 (Aeroplane Instruments, Equipment, and Flight Documents) and Chapter 7 (Aeroplane Communication and Navigation Equipment).
2. Aircraft, other than State aircraft, operating on the ATS Routes within the Lisboa FIR shall be equipped with, as a minimum, RNAV equipment meeting RNAV 5 in accordance with the requirements set out in ICAO DOC 7030 Regional Supplementary Procedures (EUR. Chapter 4 paragraph 4.1.1.2 DOC 7030).
Acceptable means of compliance are set out in Technical Guidance Leaflet nº 2 rev 1 published by the Joint Aviation Authorities on 02/6/97.
3. Within Lisboa FIR, aircraft not equipped with RNAV may use lower airspace, FL 195 or below, in ATS VOR/DME defined Routes.
4. Within Santa Maria FIR, any flight intending to fly between FL 290 and FL 410 inclusive must have the appropriate equipment and State Approval for both NAT HLA MNPS and RVSM (further details on ENR 1.1).
To comply with Commission Implementing Regulation (EU) n.1079/2012 of 16 November 2012, laying down requirements for voice channels spacing for the Single European Sky, applicable to all flights operating as general air traffic within the airspace of the ICAO EUR region, an operator shall not operate an aircraft within Lisboa FIR class C and D airspace, class G airspace in IFR, ATZ and TRMZ unless the aircraft radio equipment has the 8.33 KHZ channel spacing capability.
VFR flights requiring provision of Flight Information Service within Lisboa FIR class G airspace will not be able to establish two-way voice communications unless the aircraft radio equipment has the 8.33 KHZ channel spacing capability.
The carriage and operation of 8.33 KHZ channel spacing radio equipment is not mandatory in the Santa Maria FIR, as stated in ICAO SUPPS DOC 7030 for the NAT Region.
Regardless of airspace classification, all flights within Santa Maria FIR are required to maintain two way voice communications with the appropriate ground station providing communications and/or control in the area in which they are flying (additional details on GEN 3.4 and ENR 1.1).
